Back in March 2007, Fiola was fired from his job with the Department of Industrial Accidents (DIA).

An investigation found that his data usage on his computer was 4-times that of his co-workers.

Investigators also found that his laptop contained a great deal of child porno in the form of images and videos.

Charges were filed against him back in August, but have now been dropped.

Computer forensics experts found that he never downloaded the content, and instead his computer was hit with malware.

Now the heat is on the District Attorney’s office, as they could have avoided the long process of the case if forensic teams were brought in right away.
