Dawn of the Dead Owners Sue Capcom Over Dead Rising

The owners of the 1979 film Dawn of the Dead have filed a lawsuit against Capcom on the grounds of copyright infringement. The owners of Dawn of the Dead, MKR Group, has sued Capcom over the similarities between Dawn of the Dead and Capcom’s Xbox 360 game Dead Rising.

They stated that Capcom stole the idea of having people trapped in a mall with zombies straight from the film. The alleged copyright infringement could cost Capcom a hefty penny if it goes through.

MKR filed a complaint which stated “Both works provided thoughtful social commentary on the mall culture zeitgeist, in addition to serving up a sizable portion of sensationalistic violence.”

This comes a few weeks after Capcom filed a request for attorney fees and declatory judgment to save themselves from this type of lawsuit. They were trying to clear the air that Dead Rising does not infringe on any copyright, trademark, or intellectual property rights owned by MKR.

The suit came up before Dead Rising even released in 2006. As MKR licensing agent New Line Cinema told Capcom that the game infringed on the movie.

We will have to wait and see where it goes from here.

Capcom has stated that the idea of the game is “wholly unprotectible.”
