Dannielynn Birkhead To Be Awarded Millions In Sanctions

Dannielynn Birkhead, daughter of the late Anna Nicole Smith, could win up to $49 million dollars in sanctions thanks to a ruling made by California U.S. District Judge David O. Carter yesterday.

In the statement the judge issued yesterday he asked for this 10-year long effort by Smith’s estate to come to an end.

US District Judge David O. Carter has ordered the Marshall family holding company, to show cause why he shouldn’t pay sanctions as well.

O. Carter writes: “Pierce’s bad faith conduct was too pervasive and too egregious to be ignored, despite the fact that he has since passed away. It would promote disrespect for the authority of the federal courts to turn a blind eye to actions that so willfully and blatantly attempted to make a mockery of this justice system. Further, it would reward a party for win-at-all-costs tactics, to the deprivation of his opponent. Such behavior cannot be condoned.”

Smith was married to J. Howard from June, 1994, until his passing in March of 1996. Since that time, his son had tried everything in his power to keep her from getting his father’s money. Smith filed for bankruptcy a year after Marshall’s passing, and later won a $475 million dollar lawsuit, which was sent to the supreme court twice, and finally reversed in 2011.

Anna Nicole Smith passed away in February of 2007 shortly after the passing of her older son, Daniel, who passed away while visiting his mother in the hospital after she had given birth to Dannielynn. Any money awarded from Marshall’s estate from this point on will be given to Dannielynn. Smith’s estate is confident this amount will be fair and substantial.

Phil Boesch, lawyer of Smith’s estate, says the ruling is vindication for Smith’s rights:

“This is a complete vindication of Anna Nicole’s rights, and a total condemnation of what was done to her … We are confident that the amount Anna’s estate and daughter Dannielynn will finally be awarded will be fair and substantial.”

Anna married oil tycoon J. Howard Marshall in 1994. She wasy only 26-years-old while he was 89.

Marshall died a year later.

Meanwhile, Dannielynn is growing up to be the spitting image of her mother, who was aged just 39 when she was found dead in a Florida hotel room.

Her father Larry Birkhead, who was forced to establish paternity in a suit against Smith’s then partner and lawyer Howard K. Stern, seems to have done an excellent job raising his daughter by himself.

‘I see her mom in everything she does,’ Birkhead told UsWeekly.
‘We were at the Kentucky Derby and she started smiling and posing like her mom would. People ask me to put her in modelling, but I don’t want to push,’ he added.

Anna Nicole died from a drug overdose in 2007 at age 39.
