
Boston (DbTechNo) – A judge has ruled that companies outside of the United States can legally import electronic cigarettes into the country.
Electronic cigarettes are becoming very popular, as they are vaporless, and offer the same effect as smoking without the dreaded smell.
They run on batteries, and are becoming very popular with the younger generation of smokers.
The decision comes as the result of a lawsuit filed against the FDA by two electronic cigarette makers: Florida-based Smoking Everywhere and Arizona-based Sottera.
The FDA (Food and Drug Administration) had tried to impose a ban on electronic cigarettes, but U.S. District Judge Richard Leon put a stop to this attempt.
“This case appears to be yet another example of FDA’s aggressive efforts to regulate recreational tobacco products as drugs or devices,” he said the judge in his ruling.
“Unfortunately, its tenacious drive to maximize its regulatory power has resulted in its advocacy of an interpretation of the relevant law that I find, at first blush to be unreasonable and unacceptable.”
